How 带薪年休假 (paid annual leave) in China is calculated

Article 3 of the State Council’s **Regulations on Paid Annual Leave for Employees** (职工带薪年休假条例): *“职工累计工作已满1年不满10年的,年休假5天;已满10年不满20年的,年休假10天;已满20年的,年休假15天。”* — **5 days** from one year, **10** from ten, **15** from twenty.

**Cumulative, not with this employer.** The years are your total working years (累计工作年限), so someone with eleven years behind them starts a new job on 10 days, not 5 — though article 2 first requires a year of continuous work. Public holidays and rest days are not counted against the leave.

**When the leave is lost.** Article 4 removes the year’s leave for an employee who has winter and summer vacations longer than it, takes 20 or more days of personal leave on which the employer did not dock pay, or has long sick leave. Leave the employer does not arrange is paid at **300%** of the daily wage — including the normal day’s pay, so 200% extra. A new joiner’s first year is pro-rated by the days left in the calendar year under the 2008 implementing measures, which this page does not model.

Frequently asked questions

How many days of annual leave do you get in China?

5 working days after at least one year of cumulative work, 10 days from 10 years and 15 days from 20 years, under article 3 of the Regulations on Paid Annual Leave for Employees.

Do years with previous employers count?

Yes. The bands use cumulative working years with any employer. Article 2 separately requires a year of continuous work before the leave starts.

What happens to annual leave I do not take?

If the employer does not arrange it, it pays 300% of your daily wage for each day not taken. The 300% includes the normal day’s pay you already get, so the extra is 200%.

工作满10年年假有几天?

10天。累计工作已满10年不满20年的,年休假10天;满20年的,15天。
